AIDHR Statement: “Investigation on Farahim Ilgaroglu’s case does not fulfill expectations”
Azerbaijani Institute for Democracy and Human Rights informed its European colleagues on the case
As for information, Farahim Ilgaroglu Gasimov, correspondent of daily “Yeni Musavat” was assaulted and beaten by an unknown man or men in front of the building where he lived on April 25, 2014. While reviewing video record of incident it became clear that the journalist was beaten by professional kick boxer Feyruz Termish. The camera also caught another assaulter of the crime Tural Bayramov who was with athletic appearance. Based on unofficial information the crime was committed under the personal order of Aynar Mammadov Elton and the reason was Farahim Ilgaroglu’s series of articles about him.
In accordance with criminal code of the Republic of Azerbaijan under the article 221.1 Polis department of Nizami district launched criminal investigation related to the beaten Journalist Farahim Ilgaroglu Gasimov’s case. In the result of operative – investigation measures Feyruz Termish Haydarli who was born in 1990 was arrested on the accusation of beating the journalist. At the moment Head of the Criminal Investigation department of the Ministry of Internal Affairs is dealing with the criminal case.
Azerbaijani Institute for Democracy and Human Rights considers that physical pressures towards journalists in Azerbaijan turned to be on regular bases and investigations of these sorts of criminal incidents are not adequately conducted. Thus, the statistical figures issued by the Ministry of Internal Affairs indicate that average criminal cases which were reveled are more 95 percent. Conversely, these figures are merely 5 percent on the criminal cases committed against journalists. There have been more than 250 evidences on physical pressure, threatening and violation facts against journalist in Azerbaijan since 2005. Unfortunately, few of investigations have arrived at conclusions on these cases and accused people sentenced to imprisonment. Those who cased infringement of the law on these cases are not punished yet.
In light of this scene, expectations on Farahim Ilgaroglu, “New Musavat” correspondent’s case to be investigated adequately are not fulfilled. Although there were sufficient evidences, video recordings and other facts that submitted to the investigation related to the criminal case, final decision yet to be reached. Steps taken in this direction so far are rewarding, however, probe into the case involved only Feyruz Termish and other assaults remained beyond investigation and this very fact causes disappointments. Although Feyruz Termish who deliberately beat journalist gave the name of a person behind this crime while under custody at Polis Depart of Nizami District, it did not find its reflection on the official document. It once again questions independence/transparency of the investigation process.
Information with regard to the interferences on investigation process related to the journalist’s cases is being received. More precisely, while the investigation of Farahim Ilgaroglu’s case was going on at the Polis Department of Nazimi District some people made conspicuous interventions to the process. Following the victim’s appeal to the Ministry of Internal Affairs, the Ministry took the case under control and minister personally keeps a track on it. Regardless of this, some contradicting news is highlighted in Azerbaijani mass media. It says that Aynar Mammadov Elton who was under suspicion of giving order to beat journalist Farahim Ilgaroglu has not been involved in any investigative operation and Imposing pressure on the investigation process was made by his familiy. However, while commenting on mass media Aynar Mammadov’s father MP Elton Mammadov and his uncle Ziya Mammadov, Minister of Transportation of Azerbaijan Republic said that these accusations do not have any grounds and those who accused on crime do not have any relations with Feyruz Termish. New media and social networks gave coverage on a Feyruz Termish photo together with sportsman who brutally beat Farahim Ilgaroglu.
AIDHR declares that factually official and unofficial investigation processes on the Journalist Farahim Ilgaroglu’s case is still underway. In reference to the official information on this criminal incident so far Feyruz Termish who was born in 1990 and directly involved in this criminal case was arrested. Based on this data investigation is going on to identify another criminals who had an involvement in this incident.
Mass media which is considered fourth authority (power) gave huge coverage on evidences, photos and video records with respect to Farahim Ilgaroglu’s incident who subjected to violation. In the aggressive attack against journalist that caught by cameras it was seen that perpetrator is not alone and they act as a group.
Taking into account Azerbaijani legislation and international treaties that Azerbaijan joined in the field of human rights, Azerbaijani Institute for Democracy and Human Rights declares it inadmissible that Farahim Ilgaroglu, “New Musavat” correspondent who subjected to physical pressure and the fact that perpetrators have not been brought to justice. We also hope that along with granting the journalist guarantee, the investigation on this criminal incident will be concluded soon and those who involved will be punished in line with Azerbaijani law.
